The folks at FactCheck.org have seen, examined, and touched the certificated copy of his birth certificate, and have gotten confirmation from the controlling state agency in Hawaii that it is authentic.

There's no story here, folks. I know it causes great pain to all of you that a black guy is about to be elected President of the United States, or that someone who isn't Hillary Clinton is about to be elected President of the United States, but you better get used to the idea. Because this latest smear isn't going to stop it from happening, any more than the Muslim smears, the Rezko smears, the drug addict smears, or even your coup de grace, the Wright brouhaha.

The problem is not whether Mr. Soetoro was born in the US, it really lies more in Article 2 of the Constitution. If he has held Indonesian citizenship, which it looks like he did according to the Document from his school showing, Barry Soetoro, Indonesian, Isalm, he would have an issue with Dual loyalties and may not be eligible.

I don't know much about Mr. Berg other then he is a Prominent Democrat from Pennsylvania and a lawyer. If what he says is true this is very serious. Why is not the press at least acknowledging it and following the progress? If it is bogus then if I were Obama I would also sue. If the case has no merit, then why did the judge hold it over for closer examination? We do not know the whole story. Why doesn't Obama just hand over all the documents requested and end this? When I did so, this site [http://law.onecle.com/uscode/8/1401.html] reported that PL 99-653 of 1986 amended the law and that, under the version in effect in 1961 when the Senator was born, IF it can be proved that he was born in Kenya as alleged by some, it then follows that he is not a "natural born citizen" as required by the Constitution, and may, in fact, not be a citizen at all [in which case he also isn't eligible to serve as a US Senator].

newspapers, of course, simply report what their reporters are told. That does not make a published birth announcement a report of fact. There does exist an official document which records the birth of a child elsewhere that does not state or imply that the child was born in the state or jurisdiction issuing the document.

In that case, she apparently testified or filed an affidavit that her young son, today known as Barack Obama, had been adopted in Indonesia by her second husband. [We can't ask her now because she's deceased.]

What legal weight such a statement carries is more than I understand. Does it imply that the now Senator may still legally be an Indonesian citizen? [What steps did he take to solidify his status as an American? He is, after all, a magna cum laude graduate of Harvard Law School and surely had to at least glance at US citizenship law.]
